Vietnam Electricity (EVN) submitted a report to the Ministry of Industry and Trade outlining challenges in implementing regulations related to the Power Law. The report highlighted issues with rooftop solar installations.
According to Decree 58/2025, organizations, individuals, and households developing rooftop solar power systems for personal use must notify the Department of Industry and Trade, electricity units, and construction and fire prevention and fighting management agencies. This allows for proper management, monitoring, and guidance.
EVN reports that many, especially households, have not proactively submitted these notifications. In some cases, they failed to cooperate with electricity units or provide the necessary documentation despite receiving guidance.
However, Decree 58/2025 lacks specific provisions to determine whether this constitutes a violation. This has created difficulties for relevant agencies in imposing administrative penalties related to electricity.
EVN proposes adding a regulation that organizations and individuals who develop rooftop solar systems for self-generation and consumption without notification or registration will face penalties. The penalties would be determined by the severity of the violation, according to administrative regulations in the electricity sector.
This regulation aims to ensure compliance with notification and registration requirements, eliminate loopholes in the penalty system, and enhance state management effectiveness in accordance with the Law on Administrative Sanctions.
Vietnam currently has about 103,000 rooftop solar projects, with a total installed capacity of over 9,500 MW. The adjusted Power Development Plan VIII sets a target for 50% of office buildings and 50% of households to use self-generated rooftop solar power by 2030.
