All have been prosecuted for "violations of regulations on the management and use of state assets, causing loss and waste," under Article 219 of the 2015 Criminal Code.
Senior Lieutenant Colonel Vu Thanh Tung, deputy director of the economic, corruption, and smuggling investigation police department (C03, Ministry of Public Security), stated that the accused include: Dao Trung Sinh, director of SHB Investment and Construction Consulting JSC; Tran Van Sinh, head of the technical estimation department, Key Medical Project Management Board, Ministry of Health; Nguyen Chien Thang, former director of the Key Medical Project Management Board, Ministry of Health; and two former deputy directors, Nguyen Huu Tuan and Nguyen Kim Trung.
The C03 alleges that the accused caused damages of 80 billion VND and wasted 770 billion VND. The C03 is expanding its investigation to fully recover the assets for the state.
Nguyen Huu Dong, deputy head of the Central Committee's Internal Affairs Commission, also revealed that the government's steering committee has assigned the government's party committee to review the difficulties and obstacles facing the Bach Mai 2 and Viet Duc 2 hospital projects to put them into operation soon. The government subsequently issued a resolution to address these challenges, aiming to have the projects operational by 11/2025.

The Government Inspectorate previously concluded that the construction of the new Bach Mai 2 and Viet Duc 2 hospitals involved numerous violations of bidding, construction, and other related regulations across almost all stages. These violations led to delays of more than seven years, two extensions, and a failure to achieve the set objectives. Consequently, the projects were used inefficiently, resulting in significant waste and potential losses to the state budget totaling approximately 1,253 billion VND.
According to the Government Inspectorate, the then-Minister of Health and the responsible Deputy Minister committed violations by approving the hiring of foreign consultants to develop the project and designs without proper justification or meeting necessary conditions. They also issued unlawful directives regarding foreign consultants undertaking consulting contracts for project development. They were deemed negligent in their management, failing to supervise, inspect, and fully execute their duties and powers as investment decision-makers.
The Key Medical Project Management Board and related individuals involved in project management lacked the necessary experience and expertise. The Inspectorate asserted that these individuals "intentionally violated regulations, deliberately submitted false reports, lacked honesty and objectivity, and disregarded the appraisal of specialized agencies."
After identifying these violations, the Government Inspectorate transferred the case files and documents with evidence of "violations of bidding regulations causing serious consequences" to the Ministry of Public Security.
