On 21/1, the Key Match Incidents Panel (KMI) concluded that referee Stuart Attwell had incorrectly called a foul, believing that the Man Utd center-back pushed defender Kyle Walker before scoring. However, the panel still supported VAR's decision not to intervene, reasoning that it was not a "clear and obvious error".

The panel referenced the 28th-minute incident during the match on 7/1, when Martinez scored a rebound against Burnley from a set-piece situation. However, referee Attwell blew his whistle, believing the Argentinian center-back had fouled Walker moments earlier. Slow-motion replays indicated the push was not forceful enough to cause Walker to fall as he did, leading to strong protests from Man Utd's coaching staff. VAR reviewed the incident but did not overturn the decision.
Weeks later, the KMI voted three-two that Martinez's action did not constitute a foul and the goal should have been awarded to Man Utd. This group believed Walker "exaggerated the contact", and the decision to disallow the goal was incorrect. The panel also voted four-one in favor of VAR not intervening. In their assessment, this was a sensitive situation, not meeting the threshold to overturn the on-field decision.
The match at Turf Moor ended in a two-two draw, but the outcome could have been different had Man Utd's equalizer been allowed in the first half. Man Utd took a two-one lead against the hosts in the second half thanks to a brace from forward Benjamin Sesko. However, a superb strike from midfielder Jaidon Anthony meant Man Utd could only leave Turf Moor with one point.
This was not the first time Man Utd suffered disadvantages due to referee decisions this season. Previously, in matchweek 6, Head of Referees Howard Webb admitted VAR made an error by not intervening for the referee to issue a red card to Nathan Collins, in Brentford's three-one victory over Man Utd.
The incident where Collins pulled down Bryan Mbeumo when the forward was through on goal was identified as denying a clear goalscoring opportunity. However, the refereeing team only awarded a penalty and issued a yellow card. The referee should have issued a red card, as Collins had no intention of playing the ball.
