The government recently issued Decree 310, which amends regulations on administrative penalties for tax and invoice violations. This decree substantially increases fines for failing to issue invoices or for issuing them at the wrong time.
Penalty levels are tiered based on the number of violations, ranging from one to over 100 invoices. The lowest fine is one to two million dong, while the highest, 60-80 million dong, applies to cases where 50 or more invoices for goods and services are not issued.
Fines range from 10-30 million dong for 10-20 unissued invoices, and 30-50 million dong for 20-50 unissued invoices.
Sellers who issue invoices at the wrong time face penalties similar to those for not issuing them at all. These fines start from 500,000 dong and can go up to 70 million dong.
Under the previous Decree 125/2020, organizations and individuals faced fines of 4-8 million dong for issuing invoices at the wrong time. Failure to issue sales invoices resulted in fines of 10-20 million dong.
The Tax Management Law mandates that organizations, businesses, business households, individuals, and cooperatives must issue invoices to buyers at the point of sale.
The Ministry of Finance stated that categorizing fines by the number of invoices aims to ensure deterrence and curb tax fraud.
