On 16/8, the Security Investigation Agency of Quang Tri Province announced the indictment and detention of Nguyen Khuong Hoang, 49, from Khe Sanh Commune, for tax evasion under Article 200 of the Penal Code.

For the same offense, the investigation agency also indicted 79 Thinh Phat LLC, LB Phu Trong LLC, and Giang Hien Quang Tri LLC.

In 2022, while investigating a tax evasion case at Tan Trieu T&P Single Member LLC in Lao Bao Commune, the Security Investigation Agency discovered that Nguyen Khuong Hoang, an accountant at Tan Trieu, was providing accounting services to several businesses involved in importing and trading live animals such as buffalo, cows, and pigs. This activity showed signs of violating tax and invoice laws.

Businesses selling imported products to households, individual businesses, and organizations are required to pay a 5% value-added tax (VAT). However, Hoang legitimized these sales as being between companies to avoid paying the tax.

According to regulations, businesses and cooperatives paying VAT using the deduction method for selling unprocessed or minimally processed agricultural, livestock, aquaculture, and seafood products are not required to declare or pay VAT.

Using this method, Hoang instructed the businesses to sign sales contracts and issue false invoices to companies, recording a 0% tax rate. Then, Hoang used payment documents stating that the payments were made on behalf of the companies for accounting and tax declaration purposes.

The Quang Tri Provincial Tax Department determined that 79 Thinh Phat LLC evaded over 47.3 billion VND, LB Phu Trong LLC evaded nearly 32 billion VND, and Giang Hien Quang Tri LLC evaded 303 million VND.

The investigation is ongoing.
