According to court documents, Duffy visited his neighbor to complain about the noise from the garden fish pond, which shared a fence with his home. Believing the fish noise caused him to lose sleep, he threatened to "take matters into his own hands" if the homeowner did not address the situation.
Subsequently, on 20/3, Duffy was accused of throwing engine oil from his window into the neighbor's pond.
Four days later, the victim discovered the water pipes leading to the pond had been cut and suspected the irritable neighbor. On 26/3, three carp died in the pond; laundry detergent and cleaning agents were also found there.
The fish owner stated that surveillance camera footage recorded from 2:32 to 3:08 AM showed the defendant climbing over the fence into the garden. This serves as key evidence against Duffy.
Despite strict noise regulations in European countries, with rigid timeframes and substantial fines, humorous cases related to noise disputes frequently occur.
In late 2025, a farmer in Somme province, northern France, was prosecuted after a neighbor complained he "fed his cows from 6 AM for three consecutive days" – which the complainant deemed too early, severely impacting her delicate nerves. Fortunately, the farmer only had to pay a fine of 78 euro.
Another lawsuit between two neighbors in La Spezia province, northwestern Italy, lasted 19 years due to noise from a toilet flush in the early morning. The plaintiff, an elderly person with difficulty sleeping, claimed this posed a health hazard.
Ultimately, the early riser had to agree to change the toilet's flush location in the apartment and pay 500 euro annually to the elderly couple, starting from 2003, the year the troublesome toilet was installed.
