The Hanoi People's Committee is currently soliciting public feedback on a draft resolution from the city People's Council. This resolution outlines increased fines for certain violations related to security, social order, public safety, and other relevant areas within the city. This move operationalizes the special mechanisms stipulated in the Capital Law 2026.
According to the draft, 47 violations across security, social order, public safety, road traffic, and urban order will face higher fines than current general regulations. However, these new fines will not exceed twice the amounts stipulated by the government.
In the realm of security, social order, and public safety, the focus is on violations concerning residency, identity card management, and conditional business operations. Fines in these areas are set to increase by 1,2 to two times compared to Decree 282/2025.
Specifically, residency violations include acts such as erasing, altering, buying, selling, renting, lending, or borrowing illegal residency documents. Additionally, accommodation facilities failing to report the stay of one to three guests, or individuals appropriating, illegally using, erasing, or altering the content of another person's identity card or electronic identity card, will all face a two-fold increase in fines, raising the penalty range from 3 million to 6 million VND.
Operating conditional business sectors related to security and order without a valid license or while having a license revoked will result in fines ranging from 15 million to 30 million VND, representing a two-fold increase.
Foreign nationals traveling within Vietnam without a passport, individuals making false declarations to obtain or renew a passport, or those failing to present their passport, travel document, or other valid international travel papers will also be subject to a two-fold increase in fines.
The road traffic and urban order sectors are proposed for significantly stronger penalties, with fines doubling compared to the general rates specified in Decree 168/2024. This aims to definitively address violations such as illegal parking, encroachment on roadways and sidewalks, and overloaded vehicles.
For instance, acts such as stopping or parking on median strips; parking on a slope without chocking the wheels; stopping or parking not close to the right-hand curb (or with wheels more than 0,25 m from the curb); or stopping or parking in designated bus lanes or over drainage covers will be fined from 1,2 million to 1,6 million VND. The penalty range will increase to 1,6 million to 2 million VND if the violation occurs at an intersection, a passenger pick-up or drop-off point, or in front of an agency's entrance.
The act of illegally dumping trash, soil, sand, rocks, construction materials, or waste onto city streets will be subject to severe penalties ranging from 20 million to 30 million VND.

Using pushcarts as mobile stalls will incur fines from 200,000 to 400,000 VND. Street vending or selling small goods on sidewalks and roadways where such activities are prohibited will be fined from 400,000 to 500,000 VND.
Notably, the illegal use of roadways and sidewalks for holding markets, operating food and beverage services, displaying goods, repairing vehicles, or placing advertisements will be subject to substantial fines ranging from 4 million to 6 million VND.
The resolution is expected to take effect in 2026. Violations that occurred before the effective date of this resolution will still be subject to the general fine levels stipulated by the government. This approach ensures the protection of legal rights and the continuity of legal enforcement.
However, supplementary penalties, remedial measures, or driving license demerit points will continue to align with existing government decrees.
