A fatal accident occurred around 4:45 am on 31/8/2025, according to a lawsuit filed on 6/4 in Lancaster County court, Nebraska. Gavin Maas, then 25, stated he was driving when he saw Bailey Miller, a female runner in reflective clothing, and maneuvered his vehicle to safely avoid her.
However, Gavin reportedly did not see Bailey’s husband, Anthony, who was wearing dark clothing in the dark and rain, a detail noted in the police report.
Gavin claims Anthony was running in the middle of the road without reflective gear, which led to the collision.
"Upon realizing he had struck someone, Gavin quickly exited his vehicle and attempted to provide first aid until medical personnel arrived. Despite Gavin’s best efforts, Mr. Miller did not survive", the lawsuit states.
Anthony, a 37-year-old specialist nurse, had two daughters, aged 3 and 18 months. He was helping his wife train for a local half-marathon when he was fatally struck.

Gavin was not charged or fined for the accident, which authorities partly attributed to low light and poor weather conditions. Police also confirmed Gavin was not impaired by stimulants while driving.
The lawsuit states that Gavin suffered severe post-traumatic stress disorder (PTSD) due to the incident, leading to multiple hospitalizations, including 21 days of inpatient treatment. Since the accident, Gavin has also experienced dissociative episodes, had suicidal ideations, and reportedly told hospital staff during one stay that he "constantly saw Mr. Miller's eyes and heard Mrs. Miller's voice".
The lawsuit details that Gavin "is suffering from a range of physical and mental symptoms", and anticipates "requiring lifelong treatment, including both therapy and medication".
Gavin is seeking damages for medical expenses, including at least 50,000 USD already incurred, along with lost income, reduced earning capacity, and court costs.
The lawsuit also states that Gavin initially hoped the matter could be resolved out of court, but "issues beyond control left Gavin with no other reasonable option".
