Former Hanoi People's Court judge arrested

Nguyen Dang Phong, a former judge of the Hanoi People's Court, has been indicted on charges of misconduct during a gambling trial, including the failure to confiscate illicit proceeds.

On 7/7, Phong was indicted and temporarily detained by the Supreme People's Procuracy Investigation Agency. He is under investigation for "lack of responsibility causing serious consequences," as per Article 360, Clause 3 of the Penal Code.

This development is part of an expanded investigation by the Procuracy's investigation agency into the falsification of case files involving the Hanoi People's Procuracy. The inquiry began when investigators gathered documents related to the "Do Ngoc Ha and accomplices for organizing gambling and gambling" case. During this process, the Procuracy's investigation agency discovered two criminal investigation conclusions that shared the same number and issuance date.

Phong is accused of failing to fully carry out his assigned responsibilities during the first-instance trial of the "organizing gambling and gambling" case. His misconduct led to a discrepancy of over 89 billion VND in the determined gambling amount. The judge also violated regulations by not ordering the confiscation of illicit proceeds from the defendants.

Phong is further alleged to have ordered the return of various pieces of physical evidence to the defendants, contrary to legal regulations, causing losses to the State.

Previously, the Supreme People's Procuracy Investigation Agency indicted and temporarily detained Le Thi Hong Nhung, a former prosecutor of the Hanoi People's Procuracy. She is under investigation for "falsifying case files," under Article 375, Clause 3 of the Penal Code.

The Procuracy determined that Nhung's actions in falsifying case files led to the omission of numerous gambling offenses and gambling funds of the defendants during the Hanoi People's Procuracy's prosecution and the first-instance trial.

In addition to these actions, the Procuracy also transferred the case files to the Hanoi City Police Investigation Agency for appropriate handling. Hanoi Police subsequently indicted 8 people for organizing gambling and gambling.
