The actions of Dinh Thi Lan, 49, are outlined in a recent indictment issued by the Ho Chi Minh City People's Procuracy, which is prosecuting her for "abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and individuals" under Article 331, Clause 1 of the Penal Code.
According to the indictment, Lan owns the YouTube account named "Lan Dinh", with the link Youtube.com.@laning9888.
In 2021, she recorded and disseminated six video clips online through this account. The videos are accused of containing false or unverified information, severely defaming personal reputation and honor. They also published information regarding the personal, family, and private lives of Nguyen Phuong Hang and Huynh Uy Dung, in violation of legal provisions.
Dinh Thi Lan's actions were determined to violate Article 16, Clause 3, points a and b; Article 17, Clause 1, point d of the 2018 Cybersecurity Law; and Article 5, Clause 1, point d of Decree 72/2013/ND-CP by the Government, which regulates the management, provision, and use of internet services and online information. Authorities determined that Lan's actions infringed upon the legitimate rights and interests of individuals, negatively affecting social security, order, and safety.
Also according to the indictment, at the Ho Chi Minh City Police Investigation Agency, Dinh Thi Lan initially stated that she recorded the six video clips at her home on Le Duc Tho street, in the former Go Vap district, and uploaded them to the YouTube channel "Lan Dinh". Lan admitted to recording the videos herself and making unverified statements related to Huynh Uy Dung and Nguyen Phuong Hang.
Subsequently, Lan changed her testimony, admitting to recording the statements but denying she posted them. However, the Police Investigation Agency found sufficient evidence to prove Dinh Thi Lan was the one who uploaded these videos.
