On the morning of 27/1, at its 31st specialized session, the Hanoi People's Council (HPC) approved a Resolution implementing Clause 4, Article 7 of National Assembly Resolution 258/2025, dated 11/12/2025. This document defines the scope, subjects, criteria, compensation levels, support, and resettlement for state land acquisition. Specifically, for projects stipulated in point (a), Clause 2, Article 1 of Resolution 258, the land compensation rate will be two times the standard regulation.
For projects specified in points (b), (c), (d), and (e), Clause 2, Article 1 of Resolution 258, the land compensation rate will be 1.5 times the standard regulation. Compensation for assets, investment costs in land, support, and resettlement during state land acquisition will be one time the standard regulation.
Previously, on 11/12/2025, the National Assembly passed Resolution 258/2025 on piloting special mechanisms and policies for implementing major, important projects in the capital area. These major, important projects are categorized into five types.
First are public investment projects under the Law on Public Investment, public-private partnership (PPP) projects under the Law on Public-Private Partnership Investment, and investment projects under the Law on Investment that require immediate implementation as directed by the Politburo, the Secretariat of the Party Central Committee, the Government Party Committee, and the Hanoi Party Committee Executive Board (point a). According to the city's Resolution, these projects are eligible for land compensation at two times the standard rate.
Second are public investment projects and PPP projects that meet national important project criteria; public investment projects and PPP projects using local budget capital and other legal local capital sources with a total investment scale of 30,000 billion VND or more (point b).
Third are investment projects within the list of projects attracting strategic investors under capital city laws, with an investment capital scale of 30,000 billion VND or more (point c).
Fourth are urban area renovation, embellishment, and redevelopment projects, including: projects to rebuild apartment buildings that must be demolished under housing laws; projects to renovate, embellish, and redevelop one or more urban blocks (point d).
Fifth are new investment projects and facility renovation projects aimed at addressing urgent bottlenecks related to traffic congestion, flooding, environmental pollution, and urban order (point e).

The city is currently implementing major, important construction investment projects under Clause 2, Article 1 of Resolution 258, such as: the Olympic sports urban area; the Red River scenic boulevard axis; the Medical - Elderly Healthcare - Hanoi Medical University complex in Hoang Mai ward; and the Digital Technology Park and mixed-use area in Phu Dien and Tay Tuu wards.
According to the Hanoi People's Committee (HPC), the promulgation of this Resolution provides a crucial legal basis for the city to acquire land, compensate, support, and resettle affected residents for major, important projects in the area most expeditiously, in accordance with regulations, and fostering strong consensus among those whose land is acquired.
