This resolution stems from a mediation agreement reached on 2/6, following a decision by the People's Court Area 2 - Hanoi.
A. O. Smith Corporation, a US-based enterprise, specializes in manufacturing residential and commercial water heating equipment, including water heaters and related devices. The company is the rightful owner of the "AO" and "A. O. Smith" trademarks registered in Vietnam.
During its business operations, Dat Hung Trading and Service Joint Stock Company, located in Hanoi, had introduced products under the "AO SPANI" brand. According to the court-recognized agreement, these brand identifiers were found to be in conflict with A. O. Smith Corporation's existing trademarks.
Under the terms of the mediation agreement, Dat Hung Company committed to immediately ceasing all production, distribution, and offering for sale of products bearing the "AO SPANI" identifiers. Furthermore, the company pledged to discontinue all use of these identifiers in its business operations. Dat Hung also affirmed its commitment to adhering to intellectual property laws and respecting the intellectual property rights of all entities. The company bore the total court fees of 1,5 million dong for both parties and published a public apology in an online newspaper designated by the court.
