Ministry of public security proposes firework production expansion

The ministry of public security has proposed allowing its affiliated organizations and businesses to research and produce fireworks, alongside existing ministry of national defense enterprises.

This information is outlined in the third draft of a decree amending five existing decrees related to security, order, conditional business lines, firework use, seals, and the implementation of the law on citizen identity and residence. The decree, drafted at the request of the minister of public security, is currently under review by the ministry of justice.

Current regulations stipulate that the prime minister designates organizations and businesses under the ministry of national defense to research, produce, import, export, and supply fireworks based on state agency orders and recommendations from the minister of national defense.

The draft decree proposes amendments to decree 137/2020/ND-CP, which regulates firework management and use. The proposed changes would allow organizations and businesses under the ministry of public security to research, produce, export, import, and supply fireworks.

The ministry of public security explains that fireworks fall under the category of conditional business investment related to security and order. Therefore, they argue that the current regulation, limiting production to organizations designated by the minister of national defense, is "inconsistent with the law on investment."

According to the ministry of public security, the ministry of national defense has only designated Z121 Factory for firework production, leading to a supply shortage and price increases. They believe that restricting firework production to organizations under the ministry of national defense is impractical.

Firework trading is a conditional business line listed in Appendix IV of the 2020 law on investment.

Clause 2, Article 14 of Decree 137/2020 states that only organizations and businesses under the ministry of national defense can trade fireworks. They must also obtain a certificate of eligibility for security and order from competent police authorities and meet fire prevention, incident response, and environmental protection requirements.

Since the decree took effect in 2021, Chemical Company 21 (Z121 Factory) has introduced noiseless fireworks to the Vietnamese public, widely known as "Ministry of National Defense Fireworks."
