Central Committee discusses views on amending land law

On its first working day, the 3rd plenum of the 14th Central Committee discussed perspectives on amending the land law, aiming to refine policies and enhance the efficiency of land management and use.

The Central Committee began its 3rd plenum of the 14th tenure on the morning of 20/7, with a primary focus on amending the land law. The opening session was chaired by National Assembly Chairman Tran Thanh Man, while General Secretary and State President To Lam delivered the opening speech and presided over the conference, according to a communique from the Central Party Office on the afternoon of 20/7.

The need for amendments stems from inadequacies identified in the land law 2024, which became effective on 1/8/2024. After nearly two years, some provisions are proving problematic, particularly with the country's transition to a two-tier local government model starting 1/7/2025. A key issue is the current law's three-tier land use planning system, encompassing national, provincial, and district levels. With district-level operations having ceased, certain regulations are no longer compatible with the new administrative structure. The Ministry of Agriculture and Environment highlights that this three-tier planning model often overlaps and lacks synchronization with planning in other sectors.

The draft amendment is expected to adjust approximately 65 articles of the land law 2024. The Ministry of Agriculture and Environment has proposed considering the issuance of land use rights certificates for handwritten transactions that occurred between 2014 and 2024. Additionally, proposals include tightening land transactions during expropriation waiting periods and increasing decentralization and devolution of power to align with the two-tier government model.

The Ministry of Agriculture and Environment is currently seeking government feedback on the draft before submitting it to the National Assembly.

Other discussions during the plenum included the unanimous decision to strip all party positions from Bui Van Hai, former Secretary of Bac Giang Provincial Party Committee. The Central Committee also held group discussions on regulations for party members and a project to amend and supplement provisions for implementing the Party Charter. On the same afternoon, the Central Committee discussed a project to innovate Vietnam's development model and a preliminary review project of Resolution 18 of the 13th Central Committee on perfecting institutions and policies, improving the efficiency of land management and use.

The plenum will continue its second day of work tomorrow.
