Strictly prohibiting the transfer of individuals combating waste

A new law prohibits the transfer, deployment, or secondment of individuals combating waste while a case is under resolution.

On the morning of 10/12, the National Assembly passed the draft Law on Thrift and Anti-Waste.

The law specifies that heads of agencies and organizations receiving information about waste are responsible for receiving, processing, and resolving it according to legal provisions on denunciations and citizen reception. These heads are also responsible for handling violations within their authority or submitting them to higher authorities for resolution, publicly disclosing the results, and explaining to functional agencies why waste occurred, as stipulated.

Inspection, examination, and investigation agencies, the Supreme People's Procuracy, and heads of direct superior agencies who receive information about waste are responsible for directing and organizing clarification according to their functions and duties, preventing and promptly handling it within their authority or recommending higher authorities to take action.

Individuals combating waste and their relatives will be protected. They are entitled to compensation if competent authorities fail to apply protective measures or apply them belatedly, causing harm to their lives, health, property, or mental well-being.

The law strictly prohibits discrimination, setting arbitrary criteria, conditions, comments, or evaluations that create disadvantages in personnel work, commendation, or discipline for individuals combating waste and their relatives. It also prohibits the transfer, deployment, or secondment of such individuals while a case is being resolved.

Illegal acts such as invading homes or residences, seizing or destroying property, insulting dignity or honor, and retaliating or hiring, soliciting, or instigating others to threaten or retaliate against individuals combating waste and their relatives are also strictly prohibited.

Conversely, the law prohibits abusing anti-waste efforts to defame agencies, organizations, or individuals; using violence, pressure, slander, isolation, insult, or infringing upon the rights and interests of individuals combating waste and their relatives.

Minister of Finance Nguyen Van Thang stated that acts of waste and violations in organizing anti-waste efforts are stipulated directly in the law. This aims to fully institutionalize the guidelines of the Central Steering Committee on Anti-Corruption, Waste, and Negativity, while also inheriting some current regulations to ensure proper identification of these acts.

Clearly identifying wasteful acts demonstrates the determination of the Party and the State to thoroughly address issues that hinder socio-economic development and cause the country to miss development opportunities.

The law will come into effect on 1/7/2026.
