On 24/6, following nearly one year of supplementary investigation, the Ho Chi Minh City People's Procuracy issued an indictment prosecuting Phan Cong Khanh (32 years old, also known as Khanh Super), Huynh Xuan Van (39 years old), and Mohamach Da Pha (30 years old, residing in An Giang) for abuse of trust to appropriate property.
Van is currently a fugitive and has been indicted in absentia.
Last year, prosecutors initially completed an indictment charging Khanh with fraudulent appropriation of property. Mohamach Da Pha was charged with two offenses: fraudulent appropriation of property and abuse of trust to appropriate property. During the case review, the court returned the file for further investigation to clarify the defendants' specific charges.
Under the Criminal Code, the maximum penalty for fraudulent appropriation of property is life imprisonment, while abuse of trust carries a maximum sentence of 20 years in prison.

Khanh, originally from Ben Tre, gained notoriety for owning a collection of supercars. He served as the legal representative for K-Supper Company in Saigon, which specialized in luxury car sales.
The newly issued indictment states that Khanh, facing business losses and needing funds to repay debts, conspired with Van and Pha. They used deceptive tactics to appropriate a McLaren car, valued at 7,1 billion VND, from Ms. Huong, subsequently pawning it.
Additionally, in january 2022, Khanh sold a Brabus G800 car to a man for 24 billion VND. By june 2023, Khanh contacted the car's owner, requesting to borrow the vehicle for display at his showroom in central Saigon. Trusting Khanh, the owner lent him the car along with its documents.
Exploiting this, Khanh and Van then falsely told Mr. Phuong, a new customer, that their company had purchased a Brabus G800. Believing them, Mr. Phuong agreed to buy it for 24,5 billion VND. After Mr. Phuong transferred the 24,5 billion VND, Khanh evaded contact and used the money for personal purposes.
Mohamach Da Pha borrowed a BMW car, valued at 870 million VND, from Mr. Su for his use. He then unilaterally pawned it for one billion VND, giving the money to Van. Meanwhile, Pha continued to tell Mr. Su that he was still using the car.
Beyond these three alleged acts, Khanh and Van face numerous other accusations of property appropriation. However, investigators have determined that there is insufficient evidence for these cases at this time, and they have been separated for later investigation and handling.
