Spectator hit by flying baseball bat sues for 10 million USD

Stephanie, seated in the fourth row watching a baseball game, was unexpectedly struck in the head by a bat that slipped from a player's hand, causing a brain injury.

Stephanie Duluc, 37, has filed a lawsuit seeking 10 million USD in damages. The defendants include the Yankees team, Yankee Stadium, and the companies responsible for the stadium's protective netting system.

The incident occurred on June 2, when Duluc, a senior healthcare executive, attended a game between the home team New York Yankees and the Cleveland Guardians at Yankee Stadium.

According to the lawsuit, a visiting team player lost control of his bat, which then flew over the protective netting and struck Duluc's head "with great force", knocking her from her seat in the fourth row.

Duluc sustained severe injuries, including a traumatic brain injury, a concussion, and debilitating, persistent post-concussion headaches. The lawsuit alleges this was an avoidable accident caused by the defendants' negligence.

The complaint states that the defendants installed netting in front of this section that was significantly lower than in other areas. This low netting created an unprotected gap above Duluc's seat, allowing the bat to fly through with high force and velocity, directly hitting her head without obstruction.

The entire incident was captured by live television cameras.

Due to her injuries, Duluc has been unable to return to her work, the lawsuit states.
