Ho Chi Minh City authorities are currently soliciting feedback on a draft resolution concerning compensation, support, and resettlement during state land acquisition. This new mechanism is expected to shorten the site clearance time for infrastructure and urban redevelopment projects.
According to the draft, individuals whose land is acquired and who are eligible for resettlement but decline allocated housing or land and arrange their own new accommodation will receive financial support.
If the commune or ward where the land is acquired lacks a resettlement housing or land fund, the support amount will be 10% of the land compensation value, which is two times the current regulation. If the locality already has a resettlement fund, the support amount will be 5%. The area used for calculating support will not exceed the residential land allocation limit.

The city also proposes expanding resettlement policies for specific cases. Individuals currently using state-owned houses in collective residential areas, who have not yet received a certificate, have a private garden, and have used the property before 1/7/2006, may be eligible to purchase a resettlement apartment. The condition is that they own no other residential land or housing in the commune or ward where the land is acquired.
For certain special cases falling under the scope of the Law on Urban Development, the draft proposes land compensation in cash at two times the normal rate. This law is scheduled for review and approval by the National Assembly during an extraordinary session in August.
Additionally, the draft specifies that early site handover will be rewarded. If the entire land area is acquired, the handover period is 10 days for agricultural land, 20 days for residential land, and 30 days for industrial production, commercial, and service land, calculated from the date the land acquisition decision is issued.
For urgent projects requiring immediate site deployment, the maximum handover period is 15 days. If only a portion of the land is acquired, the corresponding periods are 5 days for agricultural land, 10 days for residential land, and 15 days for production and business land; for urgent projects, the maximum is 10 days.
The draft does not yet specify the exact bonus amounts. Under the mechanism currently applied in Decision 11/2026, households and individuals who hand over the site ahead of schedule receive a maximum bonus of 50 million VND if all their land is acquired, and 25 million VND if a portion is acquired. The maximum bonus for organizations is 100 million VND.
The city also proposes support for certain cases of stable land use that do not meet the conditions for compensation. Non-agricultural land with violations, used before 1/7/2014, may receive support ranging from 42-70% of the land value used for compensation, depending on the start date of use.
Construction works built incorrectly on land eligible for compensation, established from 1/7/2014 until before 1/8/2024, and not classified as land law violations, are proposed for support equal to 20% of the compensation within the residential land allocation limit.
According to the Ho Chi Minh City People's Committee, the locality is about to implement many large projects, including external and inter-regional roads, urban railways, freight and passenger railways, Cai Mep Ha port, Can Gio international transshipment port, and the expansion of Con Dao airport, along with flood control and wastewater treatment facilities.
Meanwhile, land compensation and site clearance alone can extend from five to over seven months. The city expects the new policies to encourage residents to hand over land early, thereby shortening preparation times and providing clear sites for projects.
