On the morning of 20/8, Minister of Public Security Luong Tam Quang, authorized by the Prime Minister, presented to the National Assembly the amended Law on Organization of Criminal Investigation Agencies. Lawmakers will discuss the draft law on 23/8, with expected approval during the year-end session.
The government states that the law amendment aims to streamline the criminal investigation system, refine regulations on duties, powers, and investigation authority, and resolve practical issues.
One of the major changes proposed is the discontinuation of the investigation agency under the Supreme People's Procuracy. Its current authority would transfer to investigation agencies within the People's Public Security and the People's Army.
The draft also proposes eliminating the District-level Police Investigation Agencies to align with a new organizational model. Under this change, Provincial-level Police Investigation Agencies would be empowered to investigate criminal cases.
The Minister of Public Security and the Minister of National Defense are tasked with deciding the assignment and transfer of authority among investigation agencies under their respective management. They will also detail the organization and structure of investigation bodies within the police and military, based on each ministry's specific framework.

Phan Chi Hieu, Chairman of the National Assembly's Law and Justice Committee, indicated that the verification agency supports the abolition of District-level Police Investigation Agencies and the discontinuation of the Supreme People's Procuracy's investigation agency.
The committee also agrees with transferring the Supreme People's Procuracy investigation agency's authority to police and military investigation bodies, and adjusting the authority of Provincial-level Police Investigation Agencies. However, the drafting agency has been asked to explore solutions for potential issues during implementation.
Regarding the organizational structure of investigation agencies within the police and military, the committee recommends that specific regulations be included directly in the law, rather than delegating guidance to the Ministers of Public Security and National Defense. This approach ensures alignment with the draft law's scope, the Law on Organization of the National Assembly, and synchronizes with the Law on Organization of the Supreme People's Procuracy and the Law on Organization of the Supreme People's Court.
The proposal to abolish the Supreme People's Procuracy's investigation agency was put forth by the Ministry of Public Security in a draft law published in 7. Under current regulations, this agency investigates crimes infringing upon judicial activities, as well as corruption and official position crimes occurring within judicial operations.
From early 2018 to the end of 3/2026, the Supreme People's Procuracy investigation agency investigated and processed 390 cases involving 700 defendants. This figure represents 0,04% of the total cases handled by all investigation agencies.
